Apple vs Epic: trial in Australia set for November 2022
There is now a date for the trial between Apple and Epic Games in Australia: it will be November 28, 2022. This procedure will follow the one that took place in the United States a few months ago and which took place on three weeks.
In a court ruling, Judge Perram of the Federal Court of New South Wales has decided that the Australian trial will begin on November 28, 2022 and run for six weeks. Epic has until September 10 of this year to file and serve its statement, and Apple has until October 22 to respond. The two groups will then have to come up with whatever evidence they want to use in the case, with the hopes of reaching an agreement by December 3.
This fight in Australia in November 2022 follows a complaint by Epic Games against Apple. The developer of Fortnite has exactly the same arguments as those for the US lawsuit, namely that Apple has anti-competitive practices. He criticizes the fact that developers are required to go through the App Store to distribute applications on iOS. The other attacks relate to the fact that Apple forces developers to use its payment system (and therefore pay a commission) and the fact that Apple does not allow third-party App Stores.
The results of the US trial are not yet known. But Epic is hoping that courts in different countries will find it right in forcing Apple to review its rules for the distribution of applications.
